Terms of Service
These terms and conditions apply when purchasing a service on Paintly:
1. General Usage
With the purchase of a service on Paintly, you are entitled to use the end product of the service that you purchased as you wish, subject to the terms of the service itself. As a courtesy, we include design files with certain services or packages where it makes sense and this would be spelt out in the details of the service package that you purchase. Relevant service packages on our site are developed with this usage in mind. Paintly however retains the right to change the terms and conditions and licensing of the service that you purchase at any time.
Paintly Service is guaranteed to deliver as sold. We can not and do not however guarantee compatibility of our services and service products with 3rd party tools and platforms unless otherwise stated. If for some reason you are not satisfied with our service, report the issue to our support team, and we will do our best to resolve the problem in a timely manner.
3. Support Subscription
Some of our design services may come with subscription payment. In this case, the subscription will be for services and terms as stated in the offer. The subscription will renew as agreed at the frequency that was stated from the date of purchase at the same rate as the purchased package unless where otherwise stated. The subscription may be canceled at any time within your PayPal account. Canceling a subscription will result in suspended access to that particular package and suspended access to support resources for that particular package after the last successful subscription renewal. Paintly is not responsible for the failure to cancel a service subscription in the event that it is no longer desired. Canceling a service subscription is the responsibility of the customer.
Note: A service subscription is not to be confused with access to your Paintly account. Canceling a service subscription will not affect your Paintly account in any way.
Support is provided for a service that was paid for, subject to the terms of that package offering. Support includes rectifying of issues arising from the work we did before the work or job is accepted as completed. We do not provide support for the use or issues arising from the use of our service products on 3rd party sites or in 3rd party systems. Questions and inquiries should be directed to our support ticketing system.
We are unable to provide support that requires us to view websites with questionable content. Such content includes, but is not limited to, pornography, prostitution, racist content, possible scams, etc.
Note: Support is offered Monday through Friday, 9AM to 6PM MST. Support requests are answered in the order in which they are received.
We do not offer refunds for digital product sales or service subscription renewal fees. All sales are final. If there is an issue regarding a service, we will address the problem. Unfortunately, there is no effective way for us to both combat fraud and issue refunds. We will be happy to answer questions regarding our service before your purchase to ensure it will meet your needs. Thank you for your understanding.
Our services are sold under a split license. This means that we as creators and service providers protect our rights and freedoms to respect your ownership of the work we deliver to you as well as to control our own work.
Paintly grants you, the purchaser, an ongoing, non-exclusive, worldwide license to make use of the digital work that you have purchased.
You are licensed to use the item to create any end product for yourself or for your client/s. If you create an end product or service for your own client based on the service that you purchased from us, we will not be responsible for supporting your client or the outcome that your client experiences from using your service or product/service that you purchased from us.
You can only use our service products for lawful purposes. Moreover, you can’t use it in a way that is defamatory, obscene or demeaning, or in connection with sensitive subjects.
Currently, Paintly is designed to function properly on the WordPress platform 3.5 and higher. It is our job to make sure our website is up to date with the latest versions of WordPress. We cannot however guarantee it will work properly on your system, your browser and even your Internet service. There are just too many variables beyond our control at your end hence cannot accept responsibility for your inability to use our website.
